What Probate Is & Why It Matters in Nevada
Probate is the court-supervised process through which a deceased person’s estate is settled: assets are inventoried, debts are paid, and property is transferred to heirs or beneficiaries. In Nevada, a valid will doesn’t bypass this process. The will must be validated by the court before any distribution can occur. If someone dies without a will, known as dying intestate, Nevada’s succession laws under NRS 134 determine who inherits.
Nevada’s status as a community property state does affect what goes through probate. Property acquired during marriage and properly titled is generally not subject to probate. Assets with named beneficiaries, property held in a living trust, and accounts with payable-on-death designations also pass outside the process. Probate proceedings in Clark County are public record, accessible through the Eighth Judicial District Court portal.
Nevada’s Four Probate Tracks
Nevada law offers four distinct paths depending on the size and composition of the estate. Understanding which applies to your situation is the first step in moving forward.
- Affidavit of Entitlement (NRS 146.080): Available when the net estate doesn’t exceed $25,000 and includes no real property. The threshold rises to $150,000 for a surviving spouse. No court filing is required, and the affidavit can be used 40 days after death.
- Set Aside Without Administration (NRS 146.070): For estates with a net value up to $150,000, a threshold updated under SB 404, effective October 2025. A court petition is required, but full probate administration isn’t.
- Summary Administration (NRS 145.040): Available when the gross estate after encumbrances doesn’t exceed $500,000, a threshold updated under SB 404, effective October 2025. This is a condensed court process with a shorter timeline and reduced documentation requirements compared to general administration.
- General Administration: Required for estates exceeding $500,000 in probatable assets. This is the most involved process, requiring court appearances, formal creditor notices, complete documentation, and a minimum timeline of 120 to 180 days.
Real estate titled solely in the decedent’s name can’t be transferred by affidavit regardless of estate size. A court order is required in every case involving solely titled real property.
How Probate Works in Clark County
Paradise is an unincorporated community within Clark County, and probate proceedings for Paradise residents are filed with the Eighth Judicial District Court at the Regional Justice Center in Las Vegas. All Clark County probate cases are initially assigned to the probate commissioner, with hearings held on Friday mornings.
The personal representative, named as executor in the will or appointed by the court when no will exists, carries significant responsibilities: gathering and inventorying assets, publishing a Notice to Creditors, allowing the statutory period for claims, paying verified debts and applicable taxes, and distributing remaining assets to heirs. Under Nevada law, creditors with proper claims must be satisfied before any distribution occurs. Errors in filings or missed deadlines can extend the timeline and trigger additional hearings.
